The Permittee shall be responsible for open burning authorized by this permit and shall be liable for all damages caused by him/her, or others, while acting under this permit. The Permittee shall ensure that a competent person is in charge of the fire at all times and shall provide that person with sufficient equipment in order to prevent the fire from getting out of control. All burning shall be conducted and concluded between 7:00am (0700 hours) and sunset of the same day. Fires for large permitted burning materials such as stumps and other materials over 8 inches (200 mm) in diameter, that have been dried in accordance with the bylaw, may be maintained for a maximum of seventy-two (72) hours if the fire is substantially smokeless. However, no further permitted burning materials shall be added to a fire after 5:00 p.m. (1700 hours) of each day of the fire. The Permittee shall employ the safeguarding forces to actively mop-up and extinguish the fires authorized by this permit as soon as possible after the fires have been reduced to a smouldering state. No burning shall be initiated or rekindled when hazardous conditions or adverse weather conditions exist. The Permittee shall provide that a minimum separation of thirty (30) metres be maintained between the fire location and any building, forested area or flammable material. No pile of burning material shall exceed five (5) meters in diameter or three (3) meters in height unless specified in the written conditions by the Fire Chief to improve a hazardous condition. This permit does not exempt any person from conditions of any provincial legislation such as, but not limited to, the Environmental Management Act, Open Burning Smoke Control Regulation, Wildfire Act, or Wildfire Regulation. The Permittee shall totally extinguish all fires authorized by this permit on or prior to expiry date of this permit; or shall extinguish them forthwith upon suspension or cancellation of this permit or when instructed to do so by an officer of the Houston Fire Department. The Permittee shall abide by additional written conditions attached to this permit. The Permittee shall notify the District of Houston Fire Department (845-2250) prior to ignition on the day of each burn.
